1.1 "sheWellness," "we," "our," or "us" refers to the owners and operators of the Website.
1.2 "User" or "you" refers to any person accessing or using the Website.
1.3 "Service Providers" refers to retreat or travel providers who list their offerings on our platform.

2.1 You must be at least 18 years old to use our Website.
2.2 You agree to use the Website in compliance with all applicable laws and regulations.
2.3 Unauthorized use of the Website, including but not limited to hacking or data mining, is strictly prohibited.

3.3 Third-Party and sheWellness Experiences
You acknowledge that sheWellness may offer retreats and wellness experiences that are either:

• directly operated and delivered by sheWellness, or

• delivered by independent Service Providers.

You agree that your participation in any experience is subject to the specific terms and conditions applicable to that booking, including any additional requirements set by the relevant provider.

4. Listings, Bookings & Retreat Delivery

4.1 Hybrid Operating Model
sheWellness operates a curated retreat platform and may also directly design, host, and deliver retreats and wellness experiences. In some cases, retreats may be delivered by sheWellness, and in other cases by independent third-party Service Providers.
4.2 All bookings made through the Website may relate to either:

Retreats and experiences operated directly by sheWellness, or
Retreats and experiences operated by independent Service Providers.

The applicable operator will be clearly identified at the time of booking.

4.3 Third-Party Providers
Where a retreat is delivered by a Service Provider, that provider is responsible for the delivery of the experience and may have their own terms and conditions which apply in addition to these Terms.

 

4.4 Accuracy of Information
We aim to ensure all retreat information is accurate and up to date; however, details such as itineraries, inclusions, pricing, and availability may change. We reserve the right to make reasonable amendments where required.

5. Fees and Payments

5.1 Service Provision Model
sheWellness may act as the direct operator and service provider for many retreats and wellness experiences offered through the Website. In these cases, sheWellness is responsible for the design, delivery, and management of the retreat experience.

In some instances, retreats may be delivered by independent Service Providers, who will be clearly identified at the time of booking.

5.2 Pricing and Fees
Where sheWellness is the service provider, all pricing displayed includes the full cost of the retreat experience as specified in the listing. Where third-party Service Providers are involved, pricing may be set by the relevant provider and may include a commission or service fee charged by sheWellness.

5.3 Payments
All payments are processed via secure third-party payment providers. sheWellness does not store full payment card details and is not responsible for technical issues or processing delays caused by payment gateways.

5.4 Refunds and Cancellations
Refund and cancellation terms vary depending on whether sheWellness or a third-party Service Provider is delivering the retreat. Applicable terms will be clearly outlined at the time of booking and must be reviewed prior to purchase.

5.5 Commission (Where Applicable)
Where retreats are delivered by third-party Service Providers, sheWellness may charge a commission or service fee on confirmed bookings. This will be agreed with the relevant provider prior to listing.

6. Intellectual Property

6.1 All content, trademarks, logos, and materials on the Website are the property of sheWellness or its licensors.
6.2 Users may not copy, reproduce, distribute, or create derivative works based on the Website’s content without prior written consent.

7. Limitation of Liability

7.1 General Limitation
To the fullest extent permitted by law, sheWellness is not liable for any loss, damage, injury, or expense arising from your use of the Website or participation in any retreat or wellness experience, whether operated directly by sheWellness or by a third-party Service Provider.

7.2 Consumer Law Rights
Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law that cannot be lawfully excluded.

7.3 Third-Party Services
Where a retreat or experience is delivered by a Service Provider, sheWellness is not responsible for the acts, omissions, or performance of that provider, except where required by law.

8. Indemnification

You agree to indemnify, defend, and hold harmless sheWellness, its directors, contractors, and affiliates from and against any claims, liabilities, damages, losses, or expenses arising out of:

• your use of the Website,

• your participation in any retreat or wellness experience, whether operated by sheWellness or a third-party Service Provider, or

• your breach of these Terms or any applicable laws.
